GENERAL TERMS AND CONDITIONS OF CONTRACT

1. The lift companies S.I.T. S.p.A., Carosello Tonale S.p.A., and S.In.Val S.p.A. (hereinafter referred to as the “Companies”), holders of the concession, offer to the clients an integrated system of lifts and slopes/trails within the Pontedilegno-Tonale area. The Pontedilegno-Tonale Consortium (hereinafter the “Consortium”) is appointed by the above-mentioned lift companies to manage the skipass sales.
2. These general terms and conditions regulate the contractual conditions relating to the purchase and use of skipasses and point-based cards sold by the Companies; Sections III and IV also govern the contractual conditions relating to the use of skipasses and pay-per-use cards sold through the certified portals Telepass, Mypass, and Snowit.
3. The purchase and consequent possession of a skipass or travel document implies full knowledge and acceptance of these terms and conditions of sale.

Section I – THE SKIPASS

4. The traveller is required to buy a SKIPASS corresponding to their intended use. The Consortium sells skipasses at its skipass offices and online at www.pontedilegnotonale.com; skipasses may also be purchased through the certified portals Telepass, Mypass, and Snowit, according to their respective terms of sale. The prices of the SKIPASS – differentiated by type and purchaser’s age – are indicated in the price lists displayed at the skipass offices or published online at www.pontedilegnotonale.com and include VAT. Skipass prices (or deducted points) may be subject to changes resulting from fiscal, monetary, economic or social measures, as well as from transport capacity limitations ordered by the Authorities or under applicable regulations. The SKIPASS displays initials or symbols identifying the category distinctions such as ADULT, JUNIOR, SENIOR, and CHILD; in some cases, also the holder’s photograph and personal data.
5. Skipass offices accept payments in cash (within the limits of current legislation) and by major credit or debit cards. The Management also accepts payments by bank transfer, provided that the payment is received and credited to the Administrative Office prior to the skipass issue. Any request for an invoice must be made before the skipass is issued.
6. Upon purchase and receipt of the SKIPASS (or online receipt), the customer must verify that it corresponds to their request. No replacement of the SKIPASS will be made.
7. The prices of skipasses are indicated in the price lists displayed at the above-mentioned skipass offices or published online at www.pontedilegnotonale.com, and include VAT; the prices of skipasses sold on the website www.pontedilegnotonale.com are dynamic.
8. SKIPASSES are issued on Key-Card supports at a cost of €5.00 each as a deposit, refundable upon return of the support in good conditions. The customer is responsible for the proper preservation of the SKIPASS; therefore, anyone who has lost or severely damaged it, is not entitled to a refund of the paid deposit, where applicable. In some cases, SKIPASSES are sold on other types of media for which no deposit is required.
9. The SKIPASS is a valid travel document also serving as a fiscal receipt (Ministerial Decree 30.06.1992 and subsequent amendments) and it must be kept for the entire duration of transport.
10. SKIPASSES must be shown upon request to lift operators, who must be able to verify their validity and rightful ownership.
11. The SKIPASS is a personal, non-transferable document, not even free of charge. Any misuse of the SKIPASS – particularly its transfer, even as a simple or temporary exchange – will result in its immediate withdrawal and blocking/cancellation, as well as the right to take legal action against the offender, both criminally and civilly.
12. In the event of loss of daily, hourly, points-based, Bike Pass, or single-ride SKIPASSES, no re-issuance will be possible. However, in case of loss of seasonal or multi-day skipasses, it is required to inform the Consortium, which will proceed to deactivate and block the lost SKIPASS. In any case, all lost SKIPASSES are reissued at the skipass office only upon presentation by the customer of the card number shown on the support as “N° App:”, at a cost of €30,00. If the number is registered within the Pontedilegno-Tonale Official App, the first reissue is free of charge, while subsequent ones cost €30,00 (which will not be refunded even if the original SKIPASS is later found).
13. SKIPASSES issued behind presentation of a voucher will strictly correspond to the types indicated in the voucher itself and may not be altered, even prior to issue, just as skipasses purchased online may not be changed.
14. The SKIPASS price includes the right of transport, during the referring season, of skis, snowboard, or bike (where applicable), and one small luggage weighing less than 10 kg, provided that it does not hinder boarding or compromise safety, at the staff’s sole discretion. The transport of sleds, bobsleds, or animals is prohibited (except where specifically allowed). It is forbidden to ascend on ski slopes, including after lift closure. Except as otherwise provided by law, the Companies disclaim all liability for any damage to users’ property, equipment, or clothing within ski areas and/or during transport, including loading/unloading and related operations.
15. All SKIPASSES expire upon the closure of the corresponding summer or winter season.
16. Except as provided in the following Article 17, skipasses are non-refundable and non-exchangeable. No refund is granted in cases of illness, accident, or personal reasons of the holder.
17. In the event of an accident on ski slopes or bike trails duly documented by rescue staff, a partial refund of certain types of SKIPASS is available only if the holder has purchased the optional insurance policy at the time of skipass purchase. A summary of the insurance policy conditions is available at each Consortium skipass office and on the websites pontedilegnotonale.com or www.24hassistance.com. It is understood that companions of the injured person, even if insured, are not entitled to any refund of their own skipasses.
18. Pursuant to Article 30 of Legislative Decree 40/2021, skiers using alpine ski slopes must hold valid insurance covering civil liability for damage or injury caused to third parties. For this purpose, when purchasing the SKIPASS, the Consortium offers customers the option to subscribe a civil liability insurance policy for damage caused to persons or property.

Section II – TYPES OF SKIPASS

19. The types of SKIPASS available (single rides, Bike Passes, points-based, hourly, daily, multi-day up to 14 consecutive days, or seasonal passes) are detailed in the price lists displayed at all skipass offices and published on the website www.pontedilegnotonale.com.
20. Seasonal SKIPASSES are issued with a picture. The Consortium reserves the right to issue other types of SKIPASS with a picture as well.
21. The price of multi-day SKIPASSES covering periods subject to different rates is calculated based on the rate applicable to the period (seasonality) comprising the majority of the days. In the event of an equal number of days in each rate period, the higher rate will be applied.
22. People with disabilities who, while purchasing, present a valid disability certificate issued by the competent authority showing a disability level equal to or greater than 50%, or between 20% and 49%, are entitled to a discount on the official price of respectively 50% and 25%:
• on hourly skipasses;
• on skipasses valid from 1 to 14 consecutive days; and
• on single-ride skipasses for cable cars only.
This discount does not apply to Superskirama skipasses.
23. Seasonal SKIPASSES entitle holders to access operating lifts within the ski area during the summer or winter season, in accordance with the interchange agreements between lift companies and following the operating schedules of lifts and slopes/trails determined by each company’s Management. The reference season – without prejudice to the unquestionable discretion of each company’s Management to determine the opening and closing dates of its lifts – corresponds to 60 days (or 80 days for Superskirama SKIPASSES) of access to operating lifts, which may be non-consecutive, considering that:
• there is no guarantee of the running of all lifts, nor of the skiability of all slopes or the availability of all trails within the ski area;
• if one or more lifts run for a period exceeding 60 days (or 80 for Superskirama SKIPASSES), the Seasonal SKIPASS shall remain valid for such additional period;
• should all lifts be closed for health and safety reasons related to the SARS-CoV-2 virus, and the 60 guaranteed days (or 80 for Superskirama SKIPASSES) not be met, the customer will be entitled to a proportional refund of the Season Skipass price, calculated on the number of unused days in relation to those guaranteed.
24. The Superskirama Seasonal Skipass also entitles the holder to ski for five (5) days of their choice within the “Dolomiti Superski” ski area, on lifts in operation therein. The 5 days of validity in the “Dolomiti Superski” area are automatically activated on the Superskirama seasonal skipass support, with no need to request separate daily skipasses.
Any misuse of the Superskirama seasonal ski pass will result in its immediate withdrawal and the cancellation of any remaining days not yet used within the “Dolomiti Superski” area.
In the event of loss of the Superskirama seasonal pass within the “Dolomiti Superski” area, the latter, being unable to verify the original purchase of the lost pass, will not be able to issue any replacing skipass for any remaining valid days in that area. Any daily skipasses subsequently purchased following the loss of the Superskirama seasonal pass in the “Dolomiti Superski” area will not be refunded.

Section III – PROGRAMME OF LIFT OPERATION

25. The operating programme of lifts and slopes/trails of the Companies, as well as of the lift companies within the ski area corresponding to the SKIPASS, is determined respectively by the Management of the Companies and by the Management of each of the above-mentioned entities.
The cost of the SKIPASS is not linked to the number of lifts, slopes, trails, or services open to the public, but rather to the opportunity to use at least two open lifts. There is no guarantee of the operation of all lifts, nor of the skiability of all slopes or the availability of all trails.
26. The Companies are not responsible, and therefore no refund (total or partial) or replacement of the SKIPASS shall be due, in the event that - due to unforeseen circumstances beyond their control (including but not limited to excessive wind, adverse weather conditions, lack of snow, sudden and unforeseeable technical failures, or unannounced power outages) or due to competitive events, training, educational activities, or other events - a partial or total interruption of lift operations or closure of certain slopes/trails/services occurs.
Likewise, the Companies are not responsible and are not obliged to provide any refund and/or compensation in cases where, due to the closure of lifts caused by force majeure, the user incurs in expenses to return to their place of residence or departure.

Section IV – RULES TO USE LIFTS, SLOPES AND TRAILS

27. Travellers are required to comply with the transport regulations and passenger instructions displayed at all lift departure stations. They must also observe the regulations issued by the competent authorities in the interest of safety and transport regularity, as well as any other specific instructions given by lift staff, in special circumstances, for the purpose of preventing accidents.
28. Skiers are required to respect the signage displayed throughout the ski area and on the lifts. The degree of difficulty of the slopes, which is indicative, is shown on panoramic boards near the main departure stations, on ski maps distributed at all open skipass offices, and by means of coloured circular signs located along the edges of the slopes. Each skier, in order to safeguard their own and others’ safety, must assess whether the slope’s level of difficulty is compatible with its own abilities. For safety reasons, it is strictly forbidden to use the slopes after the lifts have closed, or in any case where slope closure is indicated by appropriate signage. In the event of violation of Law No. 363/2003 (Chapter III – Rules of Conduct for Users of Ski Areas), the Company or law enforcement authorities may suspend or withdraw the skipass.
29. On chairlifts, the transport of children under eight (8) years of age is permitted only if accompanied by an adult. For children taller than 1.25 metres, verification of age is not required (Ministerial Decree of 8 March 1999 and subsequent amendments). The “Sport” Decree (Law Decree No. 96/2025) has made the use of a ski helmet compulsory for all persons, both adults and minors.
30. The Bike Parks and other mountain bike trails (including shared ones) are open only during the summer season, when mountain bike use is permitted, in accordance with the applicable terms and conditions of sale.
Users of such trails must familiarise themselves with the level of difficulty indicated on local signage and on the website; they must also ride the trails with adequate skills, preparation, and suitable equipment and materials, fitting the difficulty of the trail.
Improper behaviour on the trails or violation of the above-mentioned regulations may result in suspension or withdrawal of the pass.
During the winter season, it is strictly forbidden to use Bike Park trails.
31. Dogs must be kept on a lead and muzzled. They may only be transported on certain lifts.
32. Access to the lifts is permitted in compliance with current regulations regarding any specific documentation and/or health certifications that the user may be required to possess.
Section V – FINAL PROVISIONS
33. The prices for the purchase of SKIPASSES may be subject to change as a result of fiscal, monetary, economic, or social measures, as well as in the event of transport capacity limitations ordered by the Authorities or arising from regulations.
34. In the event of any discrepancies between the different language versions of these General Terms and Conditions of Sale, the Italian version shall prevail.
35. The Consortium has adopted the measures required by the General Data Protection Regulation (GDPR – Regulation (EU) 679/2016), as specified in the privacy notice displayed at skipass offices and available on the Consortium’s website pontedilegnotonale.com, as reproduced below.

37. The Consortium reserves the right to amend these contractual conditions. Any changes will be promptly published on the website pontedilegnotonale.com and will take effect from the time of publication for purchases made thereafter.
